A conservative watchdog group has secured a court order compelling the Centers for Disease Control and Prevention (CDC) to stop deleting employee emails, highlighting potential violations of the Federal Records Act and raising concerns about transparency and accountability within the Biden administration.

The Biden administration has faced criticism for its handling of employee emails at the Centers for Disease Control and Prevention (CDC), after a conservative government watchdog group obtained a legal victory compelling the agency to halt the deletion of emails.

America First Legal (AFL), a right-leaning public interest organization, filed a lawsuit in February 2023, alleging that the CDC had violated the Federal Records Act by systematically deleting emails of most employees 30 days after they departed from the agency.

Under the preliminary injunction granted by the National Archives and Records Administration (NARA), Attorney General Merrick Garland must now enlist the help of Congress to recover the deleted emails and prevent further destruction of records.

AFL has emphasized the double standard in the handling of CDC emails compared to the actions taken against former President Trump, who was subjected to searches and raids at his home without his consent.

"The two-tiered justice system in the United States has never been more prevalent," AFL said in a news release.

AFL executive director Gene Hamilton praised the court order, saying, "The Biden-Harris Administration was actively destroying the records of federal employees at the CDC in blatant violation of the law."

NARA had initially dismissed the allegations, stating that CDC employees were instructed to delete emails based on their content value. However, AFL pointed out that this approach allowed individual employees to determine which emails could be automatically deleted, compromising the integrity of the record-keeping process.

The CDC has faced scrutiny in the past for its alleged influence over social media policies related to the COVID-19 pandemic. Last year, reports emerged that the agency had "significant input" on Facebook and Instagram's policies and worked to suppress dissent against the COVID vaccine.

Meanwhile, Dr. Anthony Fauci, former Director of the National Institute of Allergy and Infectious Diseases, has denied suppressing the theory that the COVID-19 pandemic originated as a result of a lab leak in Wuhan, China.

The court order and ongoing investigation into the CDC's email deletion practices raise concerns about transparency and accountability within the Biden administration.
