Former assistant U.S. attorney Andy McCarthy has sparked a call for 25th Amendment hearings after President Biden's feeble performance in last week's presidential debate. McCarthy, a Fox News contributor, appeared on "Outnumbered" and expressed alarm over Biden's visibly confused state, inability to complete sentences, and mouth hanging agape during the event.
"I think it’s time to have 25th Amendment hearings," McCarthy emphasized. "I don’t really care that much about the campaign when it comes to this issue…The ‘threat’ environment we are in today is reminiscent of right before 9/11, except right before 9/11 we didn’t have war raging in Europe and the Middle East."

McCarthy's concerns have been echoed by several others, including Rep. Chip Roy (R-Texas), who introduced legislation urging Vice President Kamala Harris to invoke the 25th Amendment. The resolution claims that Biden has repeatedly demonstrated an inability to fulfill the demands of the presidency.
Section 4 of the 25th Amendment empowers the vice president and a majority of the executive Cabinet to determine whether the president is fit to continue in office. Should they deem him unfit, the vice president would assume the presidency.

Speaker Mike Johnson has also expressed concern, stating that adversaries are perceiving the weakness in the Biden administration. House Democratic Caucus Chairman Hakeem Jeffries has defended Biden's performance, attributing it to a cold he was suffering from.
While some supporters have acknowledged that Biden had a poor debate, they contend that a single bad night should not overshadow his achievements as president. Former President Obama acknowledged that Biden's performance was subpar but criticized his opponent and defended his former vice president.
