Former Pennsylvania Democrat Steve Kochanowski expressed his dissatisfaction with President Biden and the current state of the Democratic Party, prompting him to change his party affiliation to Republican. His decision reflects a growing trend of voters in Biden's home state abandoning the Democratic Party.

Joining 'Fox & Friends' on Wednesday, Kochanowski elaborated on his reasons for switching parties. He claimed that the Biden he voted for in 2020 was not the same as the president in office today. "I'm disappointed in the direction the country is headed under the Biden administration," he said. "I don't agree with his policies."

Kochanowski's concerns align with those expressed by a group of Pennsylvania state legislators who have taken their fight against President Biden's election executive order to the Supreme Court. The group of 27 Republicans argues that the order is unconstitutional and represents an attempt by the executive branch to overreach its authority in election matters.

According to a petition filed with the Supreme Court, the legislators argue that Biden's Executive Order 14019, issued in March 2021, aims to promote voter access and eliminate barriers to voting. However, they claim that it is essentially a partisan effort targeting key demographics to benefit the president's political party and his own re-election campaign.

In their petition, the legislators argue that the Elections Clause of the Constitution gives state legislatures the exclusive authority to set the "times, places, and manner" of federal elections. They assert that Biden's executive order infringes on this authority and undermines their ability to oversee and participate in the regulation of federal elections.

The petition cites specific provisions of the executive order that allegedly empower federal agencies to facilitate voter registration and election information dissemination, actions that the legislators argue should be left to state officials.

They contend that this usurpation of their authority violates their individual rights as state legislators and deprives them of their constitutional duty to craft rules governing federal elections.

"Each individual legislator has a right to protect 'their constitutional duty to craft the rules governing federal elections,'" the petition states. "Members of the executive branch should not be permitted to strip state legislators of their Constitutional rights — representative rights of the people."

The Foundation for Government Accountability (FGA), which filed an amicus brief in support of the legislators' case in lower court, described the issue as "the most consequential legal issue in the country."

"The outcome of this case could determine who holds the White House," said Stewart Whitson, FGA's senior director of federal affairs.

The Supreme Court will consider whether to grant the legislators' petition for a writ of certiorari, which would allow them to present their case to the court. If granted, the case could have significant implications for the balance of power between the executive and legislative branches in election-related matters.

Meanwhile, the Justice Department and the White House have not yet responded to Fox News Digital's request for comment on the case.
