Harvey Weinstein was remanded to prison following his court hearing on Wednesday, May 10, after his 2020 rape conviction was overturned by the New York Court of Appeals.

Days after being hospitalized, Harvey Weinstein appeared in person in a wheelchair at a Manhattan Supreme Court hearing, where he was remanded to prison. The hearing, predominantly procedural, followed Weinstein's overturned rape conviction.

Manhattan District Attorney Alvin Bragg emphasized the office's intent to retry Weinstein on sexual assault charges and expressed confidence in his eventual conviction. "We have every belief the defendant will be convicted again at trial," Bragg stated.

Weinstein's lawyer, Arthur Aidala, argued against remand, highlighting his client's medical issues and previous acquittal on the most serious charges. Aidala described Weinstein's health as a "train wreck" and presented concerns about his ability to endure imprisonment.

The judge scheduled a discovery hearing for May 29 and tentatively set Weinstein's new trial date for after Labor Day.

Weinstein's 2020 rape conviction was overturned on April 25 by a New York appeals court due to the inclusion of witnesses testifying about alleged assaults unrelated to the charges against him. The reversal represented a setback in the #MeToo movement.

In February 2020, Weinstein was sentenced to 23 years in prison for forcing oral sex on Mimi Haley in 2006 and raping Jessica Mann in 2013. He was acquitted of first-degree rape and predatory sexual assault charges stemming from allegations by actor Annabella Sciorra.

Weinstein has consistently denied engaging in non-consensual sex.

Despite the overturning of his New York conviction, Weinstein remains incarcerated in California, where he faces 16 years in prison for sexual assault charges involving a woman known as Jane Doe 1.

Weinstein is also facing charges in London for alleged offenses in 1996. His legal team has vowed to appeal both the California and London convictions.
