The move comes after Garland's refusal to hand over audio recordings of Special Counsel Robert Hur's interview with President Biden, prompting allegations of a cover-up within the Justice Department.
The vote passed along party lines, with 216 Republicans supporting the measure and 207 Democrats opposed. Only one Republican, Rep. David Joyce of Ohio, broke ranks and voted against the resolution. In a statement, Joyce expressed concerns about the politicization of the judicial system and emphasized the need for Congress to prioritize good governance.
The contempt vote stems from the House GOP's wider impeachment inquiry into President Biden, which has faced criticism for its partisan nature. Republicans have accused Biden of using his political position for personal enrichment and have sought the audio recordings of the Hur interview as potential evidence. Democrats, however, have dismissed the request as a political ploy and have accused Republicans of attempting to smear the President.
Attorney General Garland has defended his decision not to release the audio recordings, citing the need to protect ongoing investigations. In a statement, he expressed disappointment at the House vote and reiterated the Department of Justice's commitment to defending the Constitution and the rule of law.
The pursuit of Garland's audio recordings is part of a broader Republican strategy to investigate the Biden administration and its handling of various issues, including the ongoing investigations into classified documents and the withdrawal of U.S. forces from Afghanistan. The House GOP has also been pursuing a contempt resolution against Hunter Biden, the President's son, but has since halted its advancement.
The contempt vote against Garland follows the convictions of former Trump administration aides Peter Navarro and Steve Bannon on similar charges. Both men were found guilty of dodging subpoenas issued by the House select committee investigating the January 6th attack on the U.S. Capitol. However, the Justice Department has not acted on a third referral by Democrats for former White House Chief of Staff Mark Meadows.
House Republicans have expressed frustration over the likelihood that the Justice Department will not act on their Garland referral, accusing the DOJ of being partisan and biased. Some members have even threatened to defund certain department investigations, including the special counsel's prosecution of former President Trump.
In response to the attacks on the Justice Department, Garland took an indirect shot at Republicans in a Washington Post op-ed, denouncing threats to defund investigations and labeling them as "baseless, personal, and dangerous."
The contempt vote against Attorney General Garland represents a significant escalation in the political divide between Republicans and Democrats. It remains to be seen whether the Justice Department will take action on the referral, but the ongoing impeachment inquiry and the broader investigations into the Biden administration are likely to continue to dominate headlines for the foreseeable future.
