In their letter to Attorney General Merrick Garland and Special Counsel David Weiss, the Republican lawmakers say that Hunter Biden "knowingly and willfully" made false statements to Congress about his business dealings in Ukraine and China. They also allege that James Biden made false statements about his involvement in Hunter Biden's business dealings.
The lawmakers say that the alleged false statements "implicate Joe Biden’s knowledge and role in his family’s influence peddling schemes and appear to be a calculated effort to shield Joe Biden from the impeachment inquiry."
The White House has denied any wrongdoing by President Biden or his family.
The criminal referrals are the latest development in the Republican investigation into the Biden family. The investigation has been criticized by Democrats, who say it is politically motivated.
However, Republicans say that the investigation is necessary to determine whether the Bidens have engaged in any wrongdoing.
The Justice Department is now reviewing the criminal referrals. It is not clear whether the department will take any action on the referrals.
The criminal referrals come as Hunter Biden faces criminal gun charges in Delaware. The charges stem from a 2018 incident in which Hunter Biden allegedly lied on a gun purchase form.
