The International Criminal Court (ICC) prosecutor, Karim Khan, has announced his intention to file arrest warrants against Israel's Prime Minister Benjamin Netanyahu, Defense Minister Yoav Gallant, and three senior Hamas leaders for their alleged involvement in war crimes and crimes against humanity committed during the conflict in Gaza.

Khan stated that he has ample evidence to establish reasonable grounds for believing that Netanyahu and Gallant bear criminal responsibility for war crimes and crimes against humanity committed in the State of Palestine. He accuses them of employing starvation tactics as a means of warfare and deliberately targeting civilians.

Moreover, Khan alleges that Hamas leaders Yahya Sinwar, Ismail Haniyeh, and Mohammed Dief are criminally liable for extermination and murder as crimes against humanity, as well as hostage-taking and sexual violence. He witnessed firsthand the devastating effects of these attacks during his visit to Israeli settlements and the site of a music festival targeted by Hamas.

The ICC prosecutor's decision was met with strong criticism from Israeli officials, with War Cabinet member Benny Gantz denouncing it as a historic crime. He highlighted Israel's adherence to international law and moral codes, contrasting it with the actions of Hamas, which he described as a bloodthirsty terrorist organization.

Critics, such as Anne Bayefsky of the Touro Institute on Human Rights and the Holocaust, argue that the ICC prosecutor's actions equate Israel's self-defense with the genocidal aspirations of Palestinian terrorists. They also view it as an attempt to criminalize the Jewish people's self-determination and a consequence of the Biden administration's stance, which they claim has undermined Israel's survival at every turn.

Bayefsky emphasizes that this move directly invokes American law, requiring immediate actions to defend Israel and sanction the ICC and its actors for disrupting law and justice.

Despite Israel's rejection of the ICC's jurisdiction, the court's independent judges will ultimately determine whether the standard for issuing arrest warrants has been met. Should they approve the request, Khan will collaborate with the ICC registrar to apprehend the named individuals.

The ICC's actions have reignited the debate over the legality of Israel's military actions and the role of international organizations such as the ICC in investigating allegations of war crimes.
