Upon being pulled over, Timberlake underwent a series of standardized field sobriety tests, which he reportedly failed. The arresting officer stated in documents obtained by Fox News Digital that Timberlake "performed poorly on all standardized field sobriety tests."

Timberlake, 43, admitted to the arresting officer that he had consumed one martini and was following some friends home at the time of his arrest. However, he subsequently refused to submit to a breathalyzer test when taken to a nearby police station in East Hampton.

Court papers obtained by Fox News Digital revealed that Timberlake's refusal of a breathalyzer test could potentially complicate his legal proceedings. According to Tray Gober, a Texas trial attorney who specializes in DWI cases, such refusals are not uncommon, but they can trigger an automatic suspension of the individual's driver's license under implied consent laws. Additionally, the refusal can be used as evidence of guilt in court, although the implications may vary depending on the jurisdiction and the judge.

Legal experts have expressed mixed opinions on the wisdom of refusing a breathalyzer test in such situations. However, celebrity criminal defense lawyer Michael Huff argued that Timberlake made a "smart choice" by refusing the test to safeguard his constitutional rights. Huff explained that submitting to such tests can provide investigators with evidence they may not otherwise have and that Timberlake's defense counsel will have the opportunity to present a full legal defense strategy based on other potential factors that may have contributed to his appearance of impairment.
