In a statement, Executive Director of The Heritage Foundation's Oversight Project Mike Howell warned, "We are monitoring the calls from across the country for President Biden to step aside, either now or before the election, and have concluded that the process for substitution and withdrawal is very complicated." He emphasized the need for "appropriate election integrity procedures to be followed."

Nevada permits changes to its ballot up until the fourth Friday of June in the election year, but also allows special consideration for nominees who die or are deemed mentally unfit to proceed. Georgia would allow Biden to withdraw up to 60 days before the election, but if he withdraws afterward, his name would remain on the ballot and votes for him would be discarded.
Other states have varying restrictions on timing and reasons for withdrawal from ballots, while some have no procedures in place. This legal uncertainty makes the prospect of replacing Biden an even more perilous minefield for the Democrats.
