She claimed that she and her husband had suffered financial hardship due to the COVID-19 pandemic, which led to the cancellation of her husband's book tour. However, prosecutors presented evidence that Mosby's husband had earned significant income during the pandemic.

In her sentencing memorandum, Mosby's attorneys argued that she had made a mistake on the mortgage application, and that she had not intentionally misled lenders. They also maintained that her statements about her financial hardship were not material to her bankruptcy filing.
