Former Baltimore City State's Attorney Marilyn Mosby has been sentenced to one year of home confinement, two years of probation, and fined $45,000 for perjury and mortgage fraud. The charges stem from false statements she made on mortgage applications and lies she told under oath about the financial hardship she faced during the COVID-19 pandemic.
Marilyn Mosby, the former Baltimore City State's Attorney, was sentenced Thursday to one year of home confinement, two years of probation, and fined $45,000 for perjury and mortgage fraud. The sentence was handed down by U.S. District Judge Lydia Kay Griggsby.
Mosby was convicted in March of lying on federal mortgage applications and lying under oath about the financial hardship she faced during the COVID-19 pandemic. Prosecutors argued that Mosby had knowingly misled lenders to obtain favorable loan terms.
The charges against Mosby stem from two incidents. In 2020, she submitted a mortgage application for a $490,000 home in Florida, stating that she had received a $90,000 gift from her mother. However, prosecutors later determined that the gift money was actually a loan from Mosby's mother.
Mosby also lied under oath in a bankruptcy hearing in 2020. She claimed that she and her husband had suffered financial hardship due to the COVID-19 pandemic, which led to the cancellation of her husband's book tour. However, prosecutors presented evidence that Mosby's husband had earned significant income during the pandemic.
In her sentencing memorandum, Mosby's attorneys argued that she had made a mistake on the mortgage application, and that she had not intentionally misled lenders. They also maintained that her statements about her financial hardship were not material to her bankruptcy filing.
However, Judge Griggsby rejected these arguments, stating that Mosby had "lied on multiple occasions" and had "shown a pattern of deception." Griggsby also noted that Mosby's actions had damaged the public's trust in the justice system.
Mosby's sentence is a significant victory for federal prosecutors, who had sought a prison sentence of more than three years. It is also a major setback for Mosby, who was once considered a rising star in the Democratic Party.
In a statement following her sentencing, Mosby expressed remorse for her actions. "I deeply and sincerely regret the harm that I have caused," she said. "I take full responsibility for my actions."
Mosby's sentence will serve as a reminder that no one is above the law, regardless of their position or status. It also sends a strong message that mortgage fraud and perjury will not be tolerated.
The sentencing of Marilyn Mosby concludes a chapter in the story of Baltimore's criminal justice system. Mosby was once a symbol of hope and change, but her actions have cast a dark shadow over her legacy.
