On August 28th, Naples police responded to a 911 call from a couple alleging that an unknown woman in a silver vehicle had followed them home from a downtown area known for its restaurants and shops. Upon arriving at their residence, the couple reported that the woman's vehicle had stopped on their lawn. After a brief exchange, the couple contacted the authorities.

When stopped by a Naples officer, Heitmann initially denied being the mayor, stating, "I am Teresa Heitmann right now. I am not the mayor." The officer proceeded to inform her of the callers' account, which she interrupted, claiming that the couple had run her off the road.

Despite Heitmann's insistence that she had only consumed a glass of wine and was not intoxicated, the officer detected signs of possible impairment and requested a field sobriety test. Heitmann consented to the test while declining the officer's offer to remove her heels for the test.

Following the test, police determined probable cause to arrest Heitmann for driving under the influence. She was transported to the Naples Jail Center, where she submitted to a breathalyzer test. The results indicated blood-alcohol content (BAC) levels of 0.155 and 0.169, exceeding Florida's legal limit of 0.08.
