Former President Trump's New York trial, focusing on charges of falsifying business records, may have significant implications for his political aspirations and for the legal landscape in New York. Legal experts have highlighted the potential outcomes and their wide-ranging consequences.
A Manhattan jury is deliberating in former President Trump's New York criminal trial, where he faces charges of falsifying business records related to alleged payments made during the 2016 presidential election. The verdict in this historic case has the potential to shape the 2024 presidential election and create legal precedents in New York.
Former federal prosecutor and "Sunday Night in America" host Trey Gowdy believes it is unlikely for the jury to find Trump guilty on some charges and not others. He suggests that a guilty verdict on all counts could prevent Trump from running for office, while an acquittal would give him ammunition for a malicious prosecution lawsuit.
Manhattan District Attorney Alvin Bragg indicted Trump on 34 felony counts of falsifying business records. Prosecutors must prove that Trump not only altered records related to hush money payments but also that he did so to conceal an election-related crime, making the charges felonies instead of misdemeanors.
Staten Island defense attorney Louis Gelormino agrees with Gowdy's assessment that the jury is likely to render the same verdict on all counts. He characterizes the case as "absurd and obscene" and believes Trump should not be charged with such crimes.
If Trump is convicted, even an appeal process could take months or years to resolve. During this time, he could face bail increases or a remand order placing him in jail until his sentencing hearing. Probation offices would prepare a pre-sentencing report, and Trump would be subject to certain rules, including admitting guilt to the probation officer.

Sentencing options range from prison time to home confinement or probation. If sentenced to prison, Trump would likely be entitled to Secret Service protection. Probation would impose significant restrictions on his ability to campaign, as he would need permission to travel out of state and could face searches and surprise visits at any time.
Gelormino raises concerns about the potential for a politically motivated probation officer to abuse their power over Trump and hinder his presidential campaign. Trump has already publicly expressed his view that the case is a "witch hunt" led by Democrats.
In the event of a not guilty verdict, Trump could pursue legal action against the prosecution and the judge for malicious prosecution and malfeasance.
If the jury reaches a mistrial, prosecutors typically retry the case within a few months unless an agreement with the defense can be reached. An acquittal would allow Trump to continue his political pursuits.
Councilman Joe Borelli, a Republican who assisted Trump's campaign in acquiring permits for a recent rally, believes Trump should focus on expanding his base rather than dwelling on the criminal prosecution.
The outcome of Trump's New York trial will undoubtedly be scrutinized and debated for its potential impact on the upcoming presidential election and the legal implications it carries. It is a complex case with far-reaching consequences that may shape the political and legal landscape in the years to come.
