The recent failure of a Democrat-backed bill to expand access to in vitro fertilization (IVF) has prompted Republican senators to introduce their own legislation to protect IVF at the federal level. Senators Ted Cruz and Katie Britt argue that the procedure should receive bipartisan support and that the proposed bill would ensure its continued availability nationwide.

On Thursday, a Democrat-backed bill that aimed to expand access to IVF services failed to pass the Senate, garnering only 48 votes, short of the necessary 60 votes required to move forward. The bill sought to establish a "nationwide right" to IVF services and lower the costs associated with the procedure.

Republicans, who were widely anticipated to block the legislation, argue that the bill was too broad and redundant since IVF is already legal and available in every state. They accused Democrats of using the issue to amplify abortion access and reproductive issues ahead of the 2024 election.

Despite the general Republican opposition, Senators Lisa Murkowski of Alaska and Susan Collins of Maine were the only two GOP lawmakers to vote in favor of the Democrat-backed bill, underscoring the bipartisan potential of the issue.

The debate over IVF intensified following a ruling by the Alabama Supreme Court, which declared that frozen embryos are legally people. The ruling sparked concerns that anti-choice extremists would target IVF as the next step in their agenda.

Senate Majority Leader Chuck Schumer, a Democrat, expressed his personal connection to IVF, citing the birth of his grandson through the procedure. He urged support for the Democrat-backed bill, highlighting the importance of protecting access to IVF for millions of Americans.

In response to the Democrat-backed bill, Senators Cruz and Britt proposed their own legislation, which would prohibit states from using Medicaid funding to ban IVF treatments. However, Democrats blocked their efforts to pass the bill through a unanimous consent request.

Pro-life groups opposed the Democrat-backed bill, arguing that its broad language provided insufficient protection for embryos and parents. They criticized the bill for allowing genetic testing of embryos, selective reduction abortions, and human cloning.

The Democrat-backed bill drew criticism for potentially funneling more money into the billion-dollar fertility industry. Opponents argued that taxpayers should not be obligated to subsidize IVF treatments.

The failure of the Democrat-backed IVF bill and the introduction of a Republican alternative have thrust the issue of IVF protection into the political spotlight. As the debate continues, the future of IVF rights and access remains uncertain.
