In the wake of federal sex trafficking charges against Sean "Diddy" Combs, legal experts are drawing parallels to the infamous case of Jeffrey Epstein, a billionaire sex trafficker who allegedly exploited young women and girls. Now, Combs' defense team faces a formidable challenge: persuading the jury that any sexual encounters were consensual, despite allegations supported by leaked security video showing an assault on his ex-girlfriend.
Former federal prosecutor Neama Rahmani believes the defense will strive to paint Combs as a consensual lover and not a predator. "The strategy will likely involve attacking the credibility of the victims and trying to convince the jury that they were not forced into any sexual activity," Rahmani says. "The defense will also likely try to show that Combs is a wealthy and powerful man who would have no need to force anyone into sex."

However, Rahmani cautions that this defense is risky and could backfire if the jury finds the victims' testimony convincing. "If the jury believes that the victims were coerced or forced into sex, then Combs' defense team will have a very difficult time convincing the jury that the acts were consensual."
Legal analysts also speculate that the defense may try to distance Combs from any co-conspirators, despite the racketeering charges alleging he utilized his business empire's resources to abuse and silence victims. "The defense may try to portray Combs as a victim of his own associates, suggesting he was unaware of or not involved in any wrongdoing," says David Gelman, a defense attorney and former prosecutor.

One potential defense strategy is to emphasize Combs' reputation in entertainment circles and his lack of prior criminal history. However, Gelman notes that jurors may be skeptical of this line of defense, especially given the multiple civil lawsuits alleging sexual misconduct and domestic abuse.
The case against Combs is expected to reveal additional information through court proceedings. Rahmani believes prosecutors may seek to pressure unnamed co-conspirators to testify against him. "Other members of the RICO conspiracy are criminally liable for the sex trafficking even if they didn't actually participate in the sex acts," she says.

Trial attorney Spencer Kuvin, who represents victims of Epstein, emphasizes the importance of holding wealthy and powerful individuals accountable. "The federal authorities will hopefully continue to show them that they are not above the law," he says.
Despite the Epstein case leaving unanswered questions about his "client list," the Combs case is expected to shed light on the extent of Combs' alleged involvement and the potential ramifications for his associates. As the case unfolds, legal observers will closely scrutinize the defense's strategy and the evidence presented by the prosecution.
