The Supreme Court has issued a ruling that restricts the Justice Department's ability to prosecute former President Trump, citing presidential immunity for certain actions. The decision casts doubt on the ongoing investigation and potential charges related to the 2020 election.
The Supreme Court's recent opinion in Trump v. United States has dealt a significant blow to the Department of Justice's (DOJ) investigation and potential prosecution of former President Donald Trump. The Court ruled that presidents and former presidents enjoy immunity from prosecution for "core constitutional powers" and "official acts," leaving the DOJ with limited options in pursuing charges.
Chief Justice John Roberts' majority opinion emphasized that presidents are "entitled, at a minimum, to a presumptive immunity from prosecution for all his official acts." The Court declined to provide precise definitions for official and unofficial acts, instead leaving that determination to lower courts.

The Court explicitly stated that Trump is "absolutely immune from prosecution" for post-election discussions with Justice Department officials and "presumptively immune" for allegedly pressuring Vice President Pence.

Furthermore, the Court's ruling also applies to current President Joe Biden, protecting him from future criminal prosecution for his official actions. Regardless of one's political views, the immunity principle is crucial for ensuring the independence and effectiveness of the presidency.
