"The continuation of the gag order seems untethered from any compelling rationale, particularly in light of the election," said Johnathan Turley, a practicing defense attorney and law professor.
Turley highlights the potential conflict between the gag order and Trump's status as a leading presidential candidate, effectively limiting his ability to communicate with the public during a crucial period of his campaign.

"You have a local New York judge effectively limiting what the leading presidential candidate can say in the months leading up to an election," Turley said.

John Shu, a constitutional attorney, noted that many of New York's most notorious defendants, including mobsters like Lucky Luciano and John Gotti, were not subject to similar restrictions.
"The Manhattan DA’s office has charged all kinds of high-profile criminal defendants throughout its history, ranging from celebrities to gangsters, such as Lucky Luciano, the head of La Commissione, and they weren’t silenced the way former President Trump was," Shu said.
The implications of the gag order extend beyond Trump's individual case, raising broader concerns about the potential impact on freedom of speech in the context of political campaigns.
"The Trial is over and there’s no chance that Judge Merchan is going to vacate the verdict and grant a retrial," Shu said. "Both the verdict and the gag order now will go through the New York state appellate system as two separate appeals."
As Trump's campaign spokesperson Steven Cheung pointed out, the gag order disproportionately affects the former president while excluding his political opponents and critics.
"The Gag Order wrongfully silences the leading candidate for President of the United States, President Trump, at the height of his campaign," Cheung said.
The controversy surrounding Trump's gag order highlights the complex intersection of the judicial process, freedom of speech, and political campaigns, with experts raising concerns about the potential erosion of constitutional rights in the name of maintaining fairness and integrity.
